**Phone Memories – Audio Guestbook Hire Terms and Conditions**

**1. Agreement**

By booking the services of “Phone Memories” for Audio Guestbook Hire, you (the client) agree to be bound by these terms and conditions. This agreement is between “Phone Memories” (referred to as the “Company,” “we,” or “us”) and the client (referred to as “you” or “the client”).

**2. Booking and payment**

2.1. To secure your Audio Guestbook hire, a non-refundable deposit will be required at the time of booking. The deposit amount and payment details will be communicated to you upon booking. ?? Full payment will be made for phone-only packages and the phone will arrive min 2 days prior to your event and then be returned to us on the Monday following. Once the Audio Guestbook is returned we can then send you the audio files.

2.2. Remaining balances must be paid no later than 14 days before the event date unless otherwise agreed upon in writing by both parties.

**3. Cancellation policy**

3.1. In the event of cancellation by the client, the deposit will not be refunded.

3.2. Cancellations made within 14 days of the event date will require payment of 50% of the total agreed price.

3.3. If cancellation occurs within 7 days of the event date, the client will be liable for the full agreed price.

3.4. In the unlikely event that “Phone Memories” must cancel the booking due to unforeseen circumstances, we will make every effort to offer an alternative solution or a full refund of any payments made.

**4. Equipment and set-up**

4.1 “Phone Memories” will be responsible for delivering, setting up, and testing the Audio Guestbook equipment at the agreed venue and time.

4.2. The client must ensure that a suitable and secure area is provided for the equipment, protected from adverse weather conditions and potential damage.

4.3. Any damages to the Audio Guestbook equipment caused by the client or their guests will be the responsibility of the client, and repair or replacement costs will be charged accordingly.

**5. Use of Audio Guestbook**

5.1. The client and their guests shall use the Audio Guestbook in a responsible and appropriate manner, respecting the rights and privacy of others.

5.2. “Phone Memories” shall not be held responsible for the content recorded by guests on the Audio Guestbook.

5.3. The client agrees that “Phone Memories” may use the audio recordings for promotional purposes unless otherwise specified in writing by the client.

**6. Data protection and privacy**

6.1. “Phone Memories” will handle any personal data collected during the event in accordance with applicable data protection laws and our privacy policy.

6.2. “Phone Memories” will retain the audio recordings for a period of 3 months, after which they will be securely deleted or destroyed.

**7. Liability**

7.1. “”Phone Memories” will not be responsible for any injury, loss, or damage resulting from the use of the Audio Guestbook, unless it is caused by the negligence of the Company.

7.2. The liability of “Phone Memories” shall be limited to the total amount paid by the client for the Audio Guestbook hire.

7.3. If the phone is late arrival through no fault of ours or is lost we cannot be held responsible as for the courier.

7.4. If the client doesn’t receive their audio due to loss of phone or a phone malfunction, we will provide a full refund.

**8. Miscellaneous**

8.1. These terms and conditions constitute the entire agreement between “Phone Memories” and the client and supersede any prior discussions, understandings, or agreements.

8.2. These terms and conditions may only be amended or modified in writing and signed by both parties.

8.3. If any provision of these terms and conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
